A married
couple can apply for an Adoption Order in respect of any
child who is living with them. If one of them is
biologically related to the child the application can be
made any time after the child has been with them for
three months. The surrogate mother does not have to
agree to this and the court will consider what is best
for the child before making or refusing an order.
An
Adoption Order permanently transfers parental
responsibility to the applicants. |

If they are
not married, only one of them can adopt the child. |

RESIDENCY ORDER |
 |
A court may
make a Residence Order, which simply says where a child
will live. Certain people, including biological parents
of the child, do not need leave from the court to apply.
This order is not a permanent order. |
